formerly held by Pablo da Silva has never been created or 201

acknowledged by the Chilean Government, and, therefore, it is not comprised in the staff of this office. It was created solely under the personal responsibility of my predecessor ex-Consul Mr. Edgardo Rojas Hunneus, as my Government could not have made such an appointment, and this being the truth, the first step I took on taking charge of this office was to declare it nil and void as shown in the document No.3 enclosed herewith.

The material responsibility in this matter of ex-Consul for Chile Mr. Edgardo Rojas Hunneus does not appear in any of the documents I have had the honour to receive from you as they do not establish the fact of the ex-Consul receiving from the ex-"Compra- dore" the moneys that the latter received, as it is stated, from the Chinese plaintiffs, and, moreover, it has not been ascertained that such ex-Consul had any participation or interference in the sending over of the complaining passengers, in December, 1921, but the Consulate for Panama under Mr. Edmundo Molino.

I have to, most emphatically, declare that the respon- sibility incurred by the ex-Consul for Chile could only have been presumed in the case that the Compradore appointed by Mr. Edgardo Rojas Hunneus had acted under the regulations and jurisdiction of this office, but as the ex-Compradofe da Silva, knowing, as he certainly knew, that he could not send Asiatics to Chile, owing to the instructions received from the Chilean Authorities, applied to another Consulate (namely the Consulate for Panama) for that pur- pose, even against the regulations of both Countries, Panama and

Chile, that responsibility from the ex-Consul for Chile is by no

means proved, moreover, da Silva, without any authorization, appointed as his associate or partner in his unlawful acts a Chinese named Lo Shue Mau who knowing of the plight of the emigrant sent by da Silva and himself to Chile ran away from this Colony and took refuge in China.

Why any responsibility in this affair does not attain the undersigned ?

Because all the facts pertaining to the complaint introduced by
